Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and UpMe ("we," "us," or "our"), governing your access to and use of the UpMe website, console dashboard, and keep-alive polling engine.

By creating an account, authenticating via GitHub, or configuring a monitored endpoint, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of the Service.

2. Eligibility & Account Registration

You must be at least 16 years of age to register for and use UpMe. By registering, you warrant that all information provided is accurate and current.

You are responsible for maintaining the confidentiality of your authentication credentials, including your password and session tokens. You agree to notify us immediately of any unauthorized access to or compromise of your account. UpMe is not liable for losses resulting from compromised credentials.

3. Scope of Service

UpMe provides an automated keep-alive utility that transmits scheduled, non-intrusive HTTP GET requests to user-registered target endpoints. The primary purpose is to maintain container active state on cloud platforms that implement inactivity spin-downs, as well as logging round-trip response latency.

Requests are executed automatically within a non-periodic jitter window (between 60 and 300 seconds) using simulated modern browser User-Agents to prevent bot classification.

4. Endpoint Authorization & User Representations

By registering any target URL in the UpMe console, you expressly represent and warrant that:

  • You are the verified owner or operator of the target server, or you have received explicit written permission from the owner to initiate recurring HTTP requests.
  • The target endpoint is configured as a public health check, status page, or lightweight API route capable of responding to repeated HTTP GET requests without adverse system degradation.
  • The target service does not violate third-party intellectual property, privacy rights, or cloud provider acceptable use policies.

5. Prohibited Use & SSRF Restrictions

You agree not to use UpMe for any malicious, disruptive, or unauthorized purpose. The following actions are strictly prohibited:

  • Denial-of-Service (DoS) Attacks: Attempting to overwhelm third-party web services or bypass rate limits.
  • Server-Side Request Forgery (SSRF) Attempts: Registering loopback interfaces (127.0.0.1, localhost), private network subnets (10.0.0.0/8, 172.16.0.0/12, 192.168.0.0/16), or cloud instance metadata addresses (169.254.169.254). Any such attempts are blocked by automated security controls and may result in immediate account termination.
  • Malware & Phishing Infrastructure: Using UpMe to maintain uptime for scam pages, credential harvesters, or malicious payload distributors.
  • Reverse Engineering: Attempting to decompile, disrupt, or exploit the UpMe backend infrastructure or scheduling workers.

6. Quotas & Fair Use Policy

UpMe is provided free of charge to software developers. To guarantee equitable resource availability and system stability:

  • Endpoint Limits: Accounts on the free tier are limited to a maximum of five (5) active targets concurrently.
  • Jitter Interval Bounds: Automated pulse intervals are determined by system scheduling algorithms within the 60-to-300-second window. Requests for sub-second high-frequency polling are not supported.
  • Telemetry Retention: Historical ping records are maintained under a First-In, First-Out (FIFO) queue of up to 6 events per target.

7. Third-Party Hosting Platforms

UpMe functions independently of third-party cloud hosting providers. We do not control their container lifecycle policies, networking layers, or compute quotas.

You acknowledge that cloud providers may alter inactivity sleep algorithms, impose monthly compute hour caps, or suspend applications independently of UpMe keep-alive operations. UpMe is not liable for hosting provider charges, billing overages, or third-party platform terminations.

8. Intellectual Property

All software, algorithms, visual design, and brand assets associated with UpMe are the exclusive intellectual property of UpMe and its maintainers. You are granted a revocable, non-exclusive, non-transferable license to access the console for managing keep-alive endpoints in accordance with these Terms.

9. Termination of Service

You may terminate your account at any time by removing your monitored endpoints or contacting us to request permanent account deletion.

We reserve the right to suspend or permanently terminate access to any account or specific target endpoint, without prior notice, if we determine that the account has engaged in abusive behavior, attempted SSRF exploitation, or violated these Terms.

10. Disclaimer of Warranties

UPME IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT EXPRESS OR IMPLIED WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that keep-alive pulses will execute without interruption, that target endpoints will never enter sleep states, or that latency records will be error-free. You rely on the service at your sole discretion and risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL UPME OR ITS MAINTAINERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA LOSS, OR SYSTEM DOWNTIME RESULTING FROM:

  • Your access to, use of, or inability to access the Service;
  • Any third-party hosting outage, sleep event, or platform suspension;
  • Unauthorized access, alteration, or transmission of your target endpoints.
